Ein Link auf eine Homepage, auf der ein unzulässiger Link angebracht ist, stellt einen Wettbewerbsverstoß dar.

Bringen Sie auf Ihrer Homepage einen Link auf eine andere Homepage an, auf der sich ein nach Deutschem Recht unzulässiger Link befindet, führt das dazu, dass dieser Inhalt auch Ihnen zugerechnet wird. Der unzulässige Inhalt kann in einem Wettbewerbsverstoß oder aber einer Verletzung des Markenrechts begründet sein. In beiden Fällen besteht gegen Sie ein Unterlassungsanspruch.
