Entkernung eines Gebäudes

Die Entkernung eines Gebäudes wird steuerrechtlich als Neuherstellung behandelt.

Das Finanzgericht Hessen meint, dass die Entkernung eines Gebäudes einkommensteuerrechtlich der Herstellung einer Wohnung entspricht (Aktenzeichen: 11 K 6678/98). Voraussetzung ist, dass das Gebäude vollständig entkernt und in seiner Innensubstanz durch die Veränderung der Innenwände und der Geschosshöhen völlig neu gestaltet wird. Es spielt keine Rolle, wenn die Außenmauern und die tragenden Wände des Gebäudes beibehalten werden.
