Zweitwohnungsteuer für Pflegeheimbewohner unzulässig

Eine Kommune darf Pflegeheimbewohnern keine Zweitwohnungsteuer für ihre bisherige Wohnung abfordern.

Immer mehr Kommunen erheben eine Zweitwohnungssteuer. Dass man dabei aber auch über das Ziel hinausschießen kann, zeigt ein Urteil des Verwaltungsgerichts Gießen: Wer aufgrund seiner Pflegebedürftigkeit zum Umzug in ein Pflegeheim gezwungen ist, kann nicht auch noch für seine bisherige Wohnung zur Zweitwohnungssteuer veranlagt werden, zumindest wenn die Wohnung allenfalls eine bescheidene Lebensführung ermöglicht.
