Investitionszulage für leer stehende Wohnung

Für Altfälle hat der Bundesfinanzhof entschieden, dass ein Leerstand alleine noch kein Grund ist, die Investitionszulage für Mietwohnungen zu streichen.

Investitionszulagen für Mietwohnungen gibt es zwar seit einigen Jahren nicht mehr, für die Altfälle hat der Bundesfinanzhof jetzt aber eine hilfreiche Entscheidung gefällt. Demnach kann die Investitionszulage auch dann gewährt werden, wenn die Immobilien während des fünfjährigen Bindungszeitraums mehr als ein Jahr leer stehen. Voraussetzung ist lediglich, dass trotz des Leerstandes weiterhin eine Vermietungsabsicht besteht.
