Regelmäßige Arbeitsstätte eines Leiharbeitnehmers

Nicht jeder Leiharbeitnehmer kann sich auf die Rechtsprechung des Bundesfinanzhofs berufen, dass ein Leiharbeitnehmer keine regelmäßige Arbeitsstätte hat.

Nach der Rechtsprechung des Bundesfinanzhofs hat ein Leiharbeitnehmer eigentlich keine regelmäßige Arbeitsstätte und kann damit die vollen Fahrtkosten statt nur der Entfernungspauschale ansetzen. Das gilt aber nach Meinung des Finanzgerichts Düsseldorf nicht für einen Leiharbeitnehmer, der dauerhaft bei einem konzernverbundenen Unternehmen eingesetzt wird. Die Frage liegt jetzt in der Revision dem Bundesfinanzhof vor.
