Auch bei gesundheitsgefährdenden Baumängeln hält der Bundesfinanzhof daran fest, dass die Kosten für einen Zivilprozess keine außergewöhnliche Belastung sind.

Der Bundesfinanzhof hält auch in Altfällen daran fest, dass Zivilprozesskosten nicht steuerlich abziehbar sind. Konkret sind die im Zusammenhang mit einem Baumängelprozess angefallenen Kosten auch dann nicht als außergewöhnliche Belastung abzugsfähig, wenn die Baumängel gesundheitsgefährdender Natur sind.
