Teilabzugsverbot durch verdeckte Gewinnausschüttung

Schon eine vergleichsweise geringe verdeckte Gewinnausschüttuung kann später eine Anwendung des Teilabzugsverbots für einen Veräußerungsverlust zur Folge haben.

Für Gewinne und Verluste aus der Beteiligung an einer GmbH gilt das Teileinkünfteverfahren. Das Teilabzugsverbot für einen Veräußerungsverlust kommt nur dann nicht zur Anwendung, wenn durch die Beteiligung keinerlei Einnahmen erzielt worden sind. Schon eine bestandskräftig festgestellte verdeckte Gewinnausschüttung ist aber eine solche Einnahme, hat das Finanzgericht Köln entschieden, womit das Teilabzugsverbot greift.
