Wertguthabenkonto eines Fremd-Geschäftsführers

Gutschriften auf dem Wertguthabenkonto eines Fremd-Geschäftsführers sind kein unmittelbar steuerpflichtiger Arbeitslohn.

Erneut hat sich der Bundesfinanzhof mit dem Zufluss von Arbeitslohn bei Wertguthabenkonten befasst und bestätigt, dass Gutschriften auf einem Wertguthabenkonto zur Finanzierung des vorzeitigen Ruhestands kein unmittelbar zufließender Arbeitslohn sind. Dies gilt entgegen der Auffassung der Finanzverwaltung auch für Gutschriften auf dem Wertguthabenkonto des Fremd-Geschäftsführers einer GmbH. Fremd-Geschäftsführer sind trotz ihrer Organstellung in der GmbH laut dem Bundesfinanzhof beim Zufluss von Arbeitslohn genauso zu behandeln wie alle anderen Arbeitnehmer auch.
