Keine Eigenheimzulage bei Kauf vom Ehegatten

Für den Immobilienkauf vom Ehegatten gibt es keine Eigenheimzulage - auch wenn der Ehegatte die Zulage selbst nicht in Anspruch genommen hat.

Der Bundesfinanzhof hat in Fortsetzung seiner bisherigen Rechtsprechung nochmals festgestellt, dass für eine Wohnung, die Sie von Ihrem Ehegatten erworben haben, keine Eigenheimzulage gewährt wird. Für diese Frage ist es unbeachtlich, ob Ihr Ehegatte, der die Wohnung an Sie verkauft, für das veräußerte Objekt keine Förderung in Anspruch genommen hat - unabhängig davon, ob er daran mangels Eigennutzung oder aus sonstigen rechtlichen Gründen gehindert war.
