Über den Werbungskostenabzug für die Vermietung von Ferienwohnungen gibt es immer wieder Streit mit dem Finanzamt. Das Finanzgericht Niedersachsen hat dazu festgestellt: Können die ortüblichen Vermietungszeiten für Ferienwohnungen in einem Ferienort nicht zuverlässig ermittelt werden, geht dies zu Lasten des Finanzamts. Ihm obliegt die Feststellungslast, dass der Steuerpflichtige die ortsüblichen Vermietungszeiten für Ferienwohnungen um mehr als 25 % unterschreitet.
