Ungekürzte Eigenheimzulage bei Miteigentum

Ist nur ein Miteigentümer einer Wohnung berechtigt, die Eigenheimzulage zu beanspruchen, dann erhält er trotzdem die Eigenheimzulage ungekürzt.

Gehört ein Haus zwei Eigentümern, ist aber nur einer der Miteigentümer Bauherr und damit Anspruchsberechtigter für die Eigenheimzulage, kann der Anspruchsberechtigte für seinen halben Miteigentumsanteil die volle Eigenheimzulage beanspruchen. Denn dem Eigenheimzulagengesetz ist nicht zu entnehmen, dass der Fördergrundbetrag entsprechend der Anteile am Eigentum aufzuteilen ist und für einen Miteigentumsanteil dementsprechend nur ein Teilbetrag ausgezahlt wird, meint das Finanzgericht Brandenburg (Aktenzeichen: 4 K 1409/99 EZ).
